Jiah Khan Suicide Case: Eight years old pending case will now be heard by the CBI special Court

The entire Pancholi family takes a sigh of relief today. The Jiah Khan case trial in which the actor Sooraj Pancholi was accused has finally been moved to the CBI Court this afternoon. The late actress Jiah Khan’s alleged suicide case has been investigated by Mumbai police and the CBI, but trials regarding the case began in the early days of 2019. Now, the entire Pancholi family is relieved that the trial will finally be facilitated and everyone will find closure.

Advocate Prashant Patil, who represented Sooraj in the trial, said, “The order granted by the Hon’ble Sessions Court to transfer the said case to the Special CBI Court is a welcome move for my client, Sooraj Pancholi. We have been moving applications since the beginning of the trial to expedite the case and decide the matter on its merits within six months. Our applications are allowed. Even then, the trial proceedings were delayed. We then moved a Writ Petition before the Hon’ble Bombay High Court to expedite the trial and conclude it within six months. The matter has now been transferred to Hon’ble CBI Court which according to law is the correct legal position. We are confident now that the matter shall be expeditiously conducted and concluded. If the prosecution has faith in their allegations against my client, it should conduct the trial on a day-to-day basis and prove the guilt of my client. Procrastinating justice only hurts the basic principle of criminal jurisprudence. On the next date, we shall move the application to expedite the proceedings of the trial on a day-to-day basis before the Hon’ble CBI Court”, published TOI.

Eight years after the death of Jiah Khan, the case will now be heard by the special CBI Court.
The CBI sent the dupatta used by Khan for suicide to the Central Forensic Science Laboratory in Chandigarh. They also strived to retrieve messages exchanged between Khan and Pancholi by sending their phones to the forensic unit of the Federal Bureau of Investigation in the US. The application is likely to be heard by the special CBI Court again.

Jiah was found hanging in her Juhu home by her mother Rabia on June 3, 2013. Pancholi was arrested on June 10, 2013, and was granted bail in July. He is facing trial under Section 306 (abetment of suicide) under the Indian Penal Code.
